1. Introduction

Desolate Corporation, based in Bexar County, San Antonio, TX, operates DesolateCorp.com, providing custom website creation and hosting services. By purchasing any service, including Web-Revision ($35), Web-Page ($10), Web Hosting ($15), Custom Domain ($5), Expert Website Package ($150), Basic Website Package ($50), or Pro Website Package ($75), you agree to these Terms of Service. These terms govern your engagement with our services and must be accepted before purchase. Please also review our Privacy Policy and Refund Policy.

2. Our Services

We create custom websites using WordPress and host them on Hostinger under our 100 Website Plan. Services include:

• Website Creation: Building a website tailored to your specifications (e.g., Basic, Pro, or Expert Website Packages; see Section 9 for details).

• Web-Page: A single page within a website (e.g., homepage, about page, contact page), priced at $10 per page.

• Web Hosting: Hosting your website on our Hostinger 100 Website Plan for $15/year.

• Custom Domain: Purchasing a domain on your behalf through Hostinger for $5.

• Web-Revision: Modifications to an existing website we created for $35 per revision.
  Upon project completion, we transfer full control (e.g., WordPress admin access) to you, the client.

3. Project Timelines and Queue Times

Website creation timelines depend on the package purchased and our current queue:

• Basic Website Package: 3 days.

• Pro Website Package: 7 days.

• Expert Website Package: 30 days.
  These are estimated delivery times. Delays may occur due to queue times, project complexity, revisions, or client response delays. We will provide an updated timeline if delays occur. We are not liable for delays beyond our control.

4. Domain Purchase

If you purchase the Custom Domain service ($5), we will purchase the domain on your behalf through Hostinger. You will receive full ownership and control of the domain upon project completion, subject to Hostinger’s terms. You are responsible for any renewal fees after the first year.

5. Hosting Details

Our Web Hosting service ($15/year) includes hosting your website on our Hostinger 100 Website Plan, meaning you do not need to pay Hostinger directly. This hosting is valid for one year from project completion. After the initial year, you must renew hosting with us at the same rate ($15/year) or transfer your website to another provider. We are not liable for Hostinger-related issues, such as downtime or service interruptions, which are governed by Hostinger’s Terms of Service.

6. Client Responsibilities After Handover

Upon project completion, we provide full control of your website (e.g., WordPress admin credentials). You are responsible for:

• Maintaining and updating your website, including content, plugins, and security.

• Renewing hosting with us ($15/year) or transferring to another provider after the initial year.
  If you purchase Web-Revision services ($35), we will handle specific updates or modifications as agreed.

7. Portfolio Display

By engaging our services, you grant Desolate Corporation permission to showcase your completed website on desolatecorp.com for portfolio and marketing purposes, including screenshots, descriptions, or links. You may opt out by emailing ChaseWilsonbusiness@gmail.com before project completion, and we will not display your website.

8. Client Responsibilities During Creation

You agree to:

• Provide accurate, lawful content (e.g., text, images) for your website.

• Ensure your content does not infringe on third-party rights (e.g., copyrights, trademarks).

• Respond promptly to requests for feedback or approvals to avoid delays.
  We are not responsible for delays caused by your failure to provide necessary materials or approvals.

9. Packages and Revisions

• Basic Website Package ($50): Includes a 5-8 page website, 1-2 plugins, 1 revision, and a 3-day delivery. Features include a functional website, responsive design, content upload, opt-in form, autoresponder integration, and social media icons. E-commerce functionality, payment integration, and SEO optimization are not included.

• Pro Website Package ($75): Includes a 9-12 page website, 3-5 plugins, 2 revisions, and a 7-day delivery. Adds e-commerce functionality (up to 25 products), payment integration, and SEO optimization, along with all Basic features.

• Expert Website Package ($150): Includes a 12+ page website, 5+ plugins, 3 revisions, and a 30-day delivery. Supports e-commerce functionality for up to 50 products, along with all Pro features.

• Web-Revision ($35): Covers specific updates to a website we previously created, with scope agreed upon in advance.

10. Payment and Refunds

Payments are due upfront and processed via Stripe or PayPal. Refunds and cancellations are governed by our Refund Policy, which allows cancellations within 3 days of purchase if work has not started.

11. Intellectual Property

We own the intellectual property rights to our website and tools used in creating your website. You retain ownership of content you provide. Upon payment and completion, you receive full rights to your website’s content and design, subject to third-party platform terms (e.g., WordPress, Hostinger).

12. Limitation of Liability

To the maximum extent permitted by law, Desolate Corporation is not liable for any direct, indirect, or consequential damages arising from our services, including website downtime, data loss, or third-party actions (e.g., Hostinger, WordPress). Our total liability is limited to the amount you paid for the service.

13. Indemnification

You agree to indemnify and hold Desolate Corporation harmless from any claims, damages, or losses arising from your use of our services, your website’s content, or your violation of these terms.

14. Disclaimers

Our services are provided “as is” without warranties, express or implied. We do not guarantee specific results, uninterrupted hosting, or compatibility with all devices. Third-party platforms (e.g., Hostinger, WordPress) are subject to their own terms, and we are not liable for their performance.

15. Termination

We may suspend or terminate services for non-payment, violation of these terms, or unlawful activity. Upon termination, you retain access to your website if hosted elsewhere.

16. Governing Law

These terms are governed by Texas law. Disputes will be resolved in Bexar County, TX courts.
